For the duration of martial law, the period for accepting an inheritance is suspended

The Resolution of the Cabinet of Ministers dated March 6, 2022 No. 209 notes that under martial law, state registration of legal entities, individuals - entrepreneurs and public formations, state registration of rights to real estate and their encumbrances is carried out taking into account certain features.

Lawyer Anna Gladun reported this in the Facebook group "Land Fund of Ukraine".

According to her, certification of powers of attorney and wills, authentication of signatures on documents is carried out without the use of special forms of notarial documents on white sheets of paper with the details of a notary printed on them using computer technology: the image of the State Emblem of Ukraine, surname, own name, patronymic, name of the state notary's office for a public notary, number of the certificate of the right to engage in notarial activities, workplace address, telephone number, e-mail address.

In addition, the document established that for the duration of martial law, the period for accepting the inheritance stops.

In the conditions of a martial state, powers of attorney, except for powers of attorney for the right to dispose of real estate, manage and dispose of corporate rights, and wills of military personnel of the Armed Forces, other military formations formed in accordance with the laws of Ukraine, as well as employees of law enforcement agencies, civil protection agencies involved in the implementation of activities on ensuring national security and defense, repulsing and deterring armed aggression of a foreign state, can be certified by the commander of these formations or another person authorized by such commander, with the subsequent sending of such wills through the General Staff of the Armed Forces, the Ministry of Defense, the relevant law enforcement or other body to the Ministry of Justice or its territorial body to ensure their registration by notaries in the Unified Register of Powers of Attorney, the Inheritance Register.
