The Constitutional Court postponed consideration of the law on land

The Grand Chamber of the Constitutional Court postponed until February 8 the consideration of the case on the constitutionality of the law on the circulation of agricultural land due to the lack of a quorum.

At a meeting on January 25, acting head of the Constitutional Court Viktor Kryvenko announced that at least 12 judges out of 18 must be present to hold the meeting, Ukrinform reports.

“To hold a meeting, it is necessary to have 12 judges. Since May 15, 2019, the Verkhovna Rada has not appointed one judge in the Constitutional Court. Since September 18, 2019, the Congress of Judges has not appointed a judge. Two judges – Tupitsky and Kasminin – are not allowed into the premises of the Constitutional Court by state guards without explanation of any reasons. Two referees are on vacation and one referee is sick. There is no quorum for holding a session of the Constitutional Court,” he said.

In this regard, the judge-rapporteurs in this case, Igor Slidenko and Alexander Litvinov, proposed to postpone the consideration of the case for 10:00. February 8 informed Krivenko.


For reference: on May 4, 2020, the Constitutional Court of Ukraine received the first submission on the constitutionality of the Law “On Amendments to Certain Legislative Acts of Ukraine on the Conditions for the Circulation of Agricultural Land”. There are three constitutional submissions of people's deputies on the constitutionality of the land reform under consideration by the Constitutional Court.

On April 28, President of Ukraine Volodymyr Zelensky signed the Law No. 552-IX "On Amendments to Certain Legislative Acts of Ukraine on the Conditions for the Turnover of Agricultural Land", which was adopted by the Verkhovna Rada on March 31, 2020.
